Taking On A New Dimension In The Bronx
Now lets fix the problem!

Let’s urge NYS and NYC Administration to figure out why local authorities allow a peddler from North
Carolina to continue selling furniture from his 53’ tractor trailer which according to the Department of
Consumer Affairs, Office of the General Council, is a business law violation. The saga began a couple of
weeks ago when I noticed two tractor trailers selling furniture on Bartow Avenue, just outside the main
entrance to the Co-Op City outdoor mall. I was on my way to visit a client in the area when I saw a
grandfather’s clock on the meridian along with dozens of pieces of furniture. I pulled over to find out the
details of this mobile mall. I discovered that the peddler is NOT COLLECTING NYS SALES TAX.
He bragged about going to NYC and getting a permit to peddle in all five boroughs because he is a
veteran. Little did he know that I was fact finding to put an end to his illegal operation.
I called the NYS Department of Finance to report that he was not collecting NYS Sales Tax only to find
out from the specialist on the other end of the phone that unless someone makes a purchase and
presents a bill of sale proving that no tax was collected, that they could not initiate an investigation. This
was a disappointment which made me more determined to get to the bottom of this.
There are serious repercussions from allowing illegal peddling to continue. Most recently, Seamen’s
Furniture located on White Plains Road in the Bronx announced that they were closing this location.
Soon a local landlord will not be receiving rent on the very large showroom, dozens of employees will
be out of a job, and a national retailer who is collecting and submitting NYS Sales Tax will no longer be
serving our Bronx Community. I wonder if this could have been avoided?

can see at least 3 business law violations: 1. Selling general merchandise from a motorized vehicle. 2.
Trespassing on private property which belongs to Saint Raymond’s Cemetery, and 3. Exceeding the
prescribed square feet for general merchandise.
Don’t Be Part Of The Problem
IBC Solution made a commitment to Furniture World located in Parkchester, Jennifer Convertible, an
anchor store in Co-Op City, and the rest of the furniture retailers who are paying rent, creating jobs, and
collecting NYS Sales Tax, to get to the bottom of this tax dodger. If you buy from this peddler you are
part of a serious problem which is hurting our community, our city, and our state. This peddler is
laughing at us… all of us, including our governor and mayor. Did he find a loop hole that allows him to
evade taxes? Is he setting a dangerous precedent that would allow veterans to circumvent state sales

What I don't understand is how can Assemblyman Mike Benedetto not see this guy? He Parks his rig
almost directly across the street from his office, which in only a few blocks from Community Board 10's
office. The worst part is that it appears that I'm the only one it bothers. I hope our first year
assemblyman and newly elected city councilman can recognize that if we don't do something about this
victim-less crime, we'll all wind up being the victims someday when there's just no tax revenue being
collected.
