Anna Nicole Smith Custody Is
"Small Potatoes"

Outside the Queens Supreme Court in Jamaica , NY, the sister of a frustrated litigant
claims that the hoopla over custody in the high-profile televised case, "...is small
potatoes when compared with the rampant corruption and bias in divorce courts all
over New York ." She continued tearfully, "That's what the Nicole case is all about. I
never thought it could happen to me, my family, I never realized. My poor brother. My
niece and nephew... I didn't care that the courts were crooked. You don't realize...you
don't see the damage to children when you side with the courts, because they favor
you. You think if a woman gets the better end it's for the better, but then you realize..."
First Interview: Fernando
Fearing retribution from the courts, her brother confided, "I'll give you something to
write about. Just refer to me as...Fernando."
David: "Don't you think this custody issue over Anna's child, her future and
inheritance is important?"
Fernando: "Off course, but thousands of children lose parents all the time. You don't
hear about it and the public doesn't care. It's about money and politics, not children,
not justice..."
David: "Time out. Lets step back a moment and clarify. First, how are parents losing
children?"
Fernando: "Ok. First, let’s stop with the political correct garbage. Everybody, unless
you live in a closet, knows who gets custody of a child in court, what? is it 98%."
David: "Are you saying its women?"
Fernando: "You said it. The fact that you have to ask is a politically correct pretense
of not knowing or being neutral."
David: "Ok then, to the point, are you saying that after one parent gets custody the
other parent..."
Fernando: "The other parent is relegated to something less than a boyfriend, less
than a visitor, more of a criminal. That's why it's called Visitation."
David: "Isn't all this worked out by the courts, don't they, as it's put, look out for the
best interest of the child?"
Fernando: "Don't you get it? Think for a minute about the Florida judge. Imagine... use
your head, think, imagine what these judges are like NOT under public scrutiny. They
do as they please. The courts in New York don't allow videos in family or divorce
courts because they claim it may be harmful to the children. It's a vile PRETENSE of
concern... watch on television… there is the real reason. Judges don't want to be
caught on film looking like idiots and getting caught manipulating their predetermined
agenda. They don't want people to see or have a record proving there decisions are
based on lies, don't want people to see that evidence is ignored or thrown out. Why
do you think there is no jury? Because a juror, loves truth and evidence. Can you
imagine the Founding Fathers even conceiving that this country's motto would one
day become; The first thing you lose in a court is the truth? Recall what the Florida
judge said, The truth will be what the court determines it to be on Friday."
David: "That is why we are here. I want you to give me some examples of how it works.
Explain it to me in your own words. Drink your coffee."
Fernando: "Thank you. That would take hours. I learned so much in the past year. I
never would have believed it in America ."
David: "Just for today, for now, just start at the beginning."
Fernando: "Ok. Usually, it starts with The Temporary Order of Protection. It's a way
around the Constitution."
David: "How's that?"
Fernando: "Rarely can a man get one, but say if a woman accuses her husband of
violence, without evidence or any proof at all a room full of Family court clerks jump
into action and will get her before a judge to get one signed. It's a legal scam. You
come home from work to find police waiting for you. They hand you the Temporary
Order of Protection and say you have to collect some cloths and find a place to live.
That's it. Appear in court three months later to respond to the order. You cannot
contact her or your children in that time, no phone calls, nothing, any attempt to do
so, and any accusation that you did, without proof gets you arrested. See, you have
not been arrested even though you're out on the street and you may find out your
bank accounts may have been emptied. That's the loop around the constitution, and
now that you can easily get arrested as soon as you are accused of violating the court
order, the Temporary Order of Protection, now you are a criminal, a Felon, and of
course Temporary Custody follows, which leads to, we don't want to change the
current custody status and disturb the children, so Temporary custody becomes
Permanent custody. Are you following this?"
David: "Most people would say that this is unbelievable, impossible."
Fernando: "This is nothing. I'm just giving you the preliminaries."
David: "How can this be?"
Fernando: "See, the system claims that the temporary orders protect women from
abuse. Reality? They cannot protect anyone from the rare case of a lunatic who will do
violence, order or not, but the real value is that almost every divorce that is going to
get nasty, starts or incorporates a temporary order at some point. It's how you get the
upper hand. And what's more they include accusations of child abuse, Da? You want
custody? That's how you get it. Keep an eye for fitness and child or other abuse
besides drugs in this Nicole case. I can predict it. And best of all, ready? There is no
penalty for perjury. At least not in the non-televised world."
David: "What?"
Fernando: "Look I have things to do and this stuff saturates your life, but I'm not
giving up my kids. They want you to give up, get sick, look at the suicide stats. The
lawyers, law guardians, psychologists, Forensic Evaluators, people think forensic
means like the stuff on murder shows, mediators, they all work for the court. That's
how they make money."
David: "Wait. Mediators?"
Fernando: "There is this white bearded creep at the Queens Supreme court forcing
settlements that cause ONE PARENT to loose parental rights to their children. Take a
settlement and find out how fast your children or relationship with them disappears.
Most parents are intimidated and fearful of the system. Simple, court blames both
parents to give some sense of fairness and gives custody according to the agenda.
This animal has been destroying families for years. Free mediation."
David: "Can't you get outside the system?"
Fernando: "Why should the parent most likely to win custody inside the system ever
agree to go outside the system? What? You think they care about the children?
Rational? Winning custody MEANS caring about the children. Besides, even if parents
agree to mediation outside the system, it's hard to find anything decent. A lot of the
time it’s just another stepping stone back to the court."
David: "I don't want to keep you, but we have to talk more sometime about what's
going on in this court."
Fernando: "It's not just this judge in Part 53. It's everywhere in the system top to
bottom. And if one corrupt judge gets a bit too much exposure, they rotate or promote
her to do dirty-work elsewhere."
David: "And I'd like to interview more people. Look, I took the liberty and checked
around for you. There is an interesting type of mediation out there called Focused

Potatoes", a conversation with Mediator Stan Posthumous reveals some intelligent
and human approaches to understanding relationships and a sane answer to litigation.
"Have Resolution will Travel," Stan boasts that Focused Thinking produces results
different from most regular divorce mediation, "All the couples settle their conflicts at
a deep level and well over fifty percent of them simultaneously decide to reconcile
and succeed in lasting happy relationships. Other conflict resolution processes like
traditional mediation and litigation typically produce superficial settlements. For
